Welcome to Untapped Potential. These Terms of Service govern your use of the Untapped Potential website and your purchase of products from our online store.

By accessing our website or placing an order, you agree to these Terms of Service. If you do not agree with these terms, please do not use our website or place an order.

1. About Our Store

Untapped Potential is an independent retailer of trading card games, collectible cards, sealed trading card products, accessories, and related collectibles.

We may sell products from multiple trading card games and manufacturers. We are not affiliated with, sponsored by, or endorsed by the manufacturers or publishers of the products we sell unless specifically stated.

2. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, prices, availability, and other information on our website are accurate.

However:

• Product images may be representative images rather than photographs of the exact item you will receive.
• Colors, packaging, artwork, and product configurations may vary.
• Manufacturers may change packaging or product contents without notice.
• Product release dates are subject to change by manufacturers and distributors.
• Inventory availability may change without notice.

If a product listing contains a significant error, we reserve the right to correct the error and, when appropriate, cancel and refund an affected order.

3. Trading Card Singles

For individual cards, the condition stated in the product listing is an important part of the product description.

Trading cards may have manufacturing characteristics such as print lines, off-centering, whitening, surface variations, edge variations, factory defects, or other imperfections.

Unless specifically stated otherwise, Untapped Potential does not guarantee that a raw card will receive a particular grade from PSA, Beckett, CGC, SGC, or any other grading company.

A customer's disagreement with a third-party grading result is not, by itself, evidence that a card was incorrectly described.

4. Graded Cards

When a graded card is sold, the grade assigned by the grading company is part of the product being sold.

We do not guarantee that another grading company would assign the same grade.

If a graded card is represented as being authentic and/or graded by a particular grading company, we will make reasonable efforts to ensure the item shipped matches the listing.

5. Sealed Products

Sealed products may include booster packs, booster boxes, elite trainer boxes, collection boxes, tins, cases, decks, bundles, and other factory-sealed products.

The contents of sealed trading card products are determined by the applicable manufacturer.

Untapped Potential does not guarantee:

• Specific cards will be pulled.
• A particular rarity will be included.
• A particular value will be received from opening a product.
• A product will contain a particular card unless the manufacturer specifically guarantees that content.

Once a customer opens a sealed product, the product generally cannot be returned simply because the customer is dissatisfied with its contents.

6. Prices

Prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to correct pricing errors. If an item was listed at an obviously incorrect price, we may cancel the affected order and issue a full refund.

7. Orders

Placing an order constitutes an offer to purchase the products in your order.

An order confirmation does not necessarily mean that the order has been finally accepted. We reserve the right to cancel an order for reasons including:

• Inventory errors
• Pricing errors
• Suspected fraud
• Payment problems
• Incorrect or incomplete customer information
• Manufacturer or distributor supply issues
• Other circumstances that prevent us from reasonably fulfilling the order

If we cancel an order after payment has been collected, we will issue a refund for the cancelled merchandise.

8. Order Limits

We may limit quantities purchased per customer, household, address, payment method, or account.

Quantity limits may be used to help prevent automated purchasing, scalping, fraud, or attempts to circumvent product limits.

Orders that appear to circumvent quantity restrictions may be cancelled.

9. Payment

Payment must be successfully authorized before an order can be processed.

We may use third-party payment processors to process payments. Untapped Potential does not generally receive or store customers' full payment-card numbers.

10. Shipping

Shipping information and estimated processing times are provided on our website and/or during checkout.

Customers are responsible for providing an accurate shipping address.

Once an order has been shipped, tracking information may be provided through the carrier and/or Shopify.

11. Returns and Refunds

Returns and refunds are governed by our Refund & Return Policy.

Nothing in these Terms is intended to remove any rights that cannot legally be waived.

12. Pre-Orders

Pre-orders are governed by our Pre-Order Policy.

Release dates provided by manufacturers and distributors are estimates and may change.

If a pre-order cannot be fulfilled within the applicable promised timeframe, Untapped Potential will provide customers with the options required by applicable law.

13. Fraud and Abuse

We reserve the right to cancel orders and restrict accounts where we reasonably believe there is:

• Payment fraud
• Identity fraud
• Unauthorized use of a payment method
• Excessive chargeback activity
• Abuse of return policies
• Attempts to manipulate promotions
• Automated purchasing intended to circumvent restrictions
• Other fraudulent or abusive activity

Nothing in this section authorizes us to improperly retain funds belonging to a customer.

14. Chargebacks

Customers should contact Untapped Potential before initiating a payment dispute when an order issue can reasonably be resolved through customer service.

If a chargeback is filed, we may provide the payment processor with relevant transaction information, including order records, shipping information, tracking information, correspondence, and other documentation necessary to respond to the dispute.

15. Website Use

You agree not to:

• Interfere with the operation of our website.
• Attempt unauthorized access to our systems.
• Use automated systems to abuse our website.
• Submit false information.
• Use our website for unlawful purposes.
• Attempt to manipulate prices, inventory, promotions, or checkout systems.

16. Intellectual Property

Untapped Potential's original website content, branding, logos, photographs, written content, graphics, and other original materials are owned by or licensed to Untapped Potential unless otherwise indicated.

Third-party product names, trademarks, logos, artwork, and intellectual property belong to their respective owners.

17. Third-Party Services

Our store may use third-party services, including Shopify, payment processors, shipping carriers, analytics providers, fraud-prevention services, email services, and other applications.

Your use of those services may also be subject to the terms and policies of the applicable third party.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Untapped Potential will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or purchase of products.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

19. Changes to These Terms

We may update these Terms from time to time.

The version posted on our website will be the current version.

20. Governing Law

These Terms will be governed by the laws applicable in the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.
